AMARTYA SEN E O DIREITO AO MEIO AMBIENTE SADIO E EQUILIBRADO: REPENSANDO O DIREITO AMBIENTAL NO SÉCULO XXI

Resumo

As Mudanças Climáticas e o cenário de grave emergência ambiental global em que vivemos nos impõe diversos desafios para a forma como tradicionalmente compreendemos o Direito e forçam-nos a repensá-lo nos seus pilares mais elementares. A dificuldade de não podermos saber com antecedência como responder a estas cada vez mais frequentes e impactantes emergências ambientais, nos impele a repensar drasticamente vários institutos da ética e do direito contemporâneo. Obriga-nos, sobretudo, a repensar a forma como a tutela jurídica do meio ambiente e os direitos humanos sempre foram pensados e executados e a reformular a lógica antropocêntrica e liberal-privatista da separação destes universos do direito no âmbito internacional. Assim, pautado neste complexo e relevante cenário ético-jurídico, este trabalho teve por objetivo explorar este argumento na linguagem dos direitos humanos, mais especificamente na vertente intergeracional dos Direito Humanos ao Meio Ambiente Sadio. O artigo buscou examinar também a forma como o pensamento de Amartya Sen pode contribuir para o aprimoramento do debate e fortalecimento dos argumentos à favor do maior reconhecimento deste direito humano como algo eticamente justificável e juridicamente válido nos tempos atuais.

Biografia do Autor

Diego Emanuel Arruda Sanchez, Pontifícia Universidade Católica do Paraná - PUCPR

Doutorando em Direito pela Pontifícia Universidade Católica do Paraná (CAPES 6) e mestre em Ecologia pelo Instituto Nacional de Pesquisas da Amazônia (2008), é também bacharel em Ciências Biológicas pela Universidade Federal do Paraná (2004), em Direito pela Universidade do Estado do Amazonas (2015), especialista em Direito Tributário pela Pontifícia Universidade Católica de Minas Gerais (2018) e em Direito do Trabalho e Processual do Trabalho pela Universidade Anhanguera (2020). Servidor Público Federal desde o ano de 2009, neste ógão já ocupou diversos cargos e funções, entre elas destacam-se as de: Autoridade Julgadora (2012-2018), Assessor de Gabinete da Superintendência do Ibama no Paraná (2019-2020) e de representou do órgão no Conselho de Meio Ambiente do Estado do Amazonas (CEMMAAM), da cidade de Manaus (COMDEMA) e de Parintins (COMDECAM). Advogado inscrito na Seccional da OAB no Paraná (n. 84.544/OAB-PR), atualmente atua como analista ambiental do Núcleo de Licenciamento Ambiental da Superintendência do Ibama no Paraná e possui experiência em Ecologia, Ecologia de Populações, Ecologia Humana, em Direitos Socioambientais, Trabalhistas, Humanos e dos Consumidores, com especial ênfase no Direito Socioambiental e nas conexões desta área do direito com os Direitos Humanos e a teoria da Sociedade de Risco.
