The challenges posed to German criminal law by the so-called Pedo Hunters

Abstract

This article examines the legal challenges posed by the phenomenon of so-called “Pedo Hunters” under German criminal law and criminal procedure. It addresses the central research problem of whether private individuals who deliberately provoke and expose suspected child sexual offenders act within the limits of the law and how the evidence they produce should be treated in criminal proceedings. The study was conducted through a doctrinal analysis of German substantive and procedural criminal law, combined with the examination of case law and relevant legal literature. The analysis considers the criminal liability of both the suspected offenders and the Pedo Hunters themselves, as well as the procedural admissibility of privately obtained evidence. The findings indicate that, although the state must investigate reported offenses, the activities of Pedo Hunters may themselves constitute criminal conduct, while evidence obtained through serious procedural violations remains inadmissible, preserving the rule of law and due process guarantees.
