Abstract

Este artigo discute o direito dos povos indígenas e comunidades tradicionais à consulta prévia, livre e informada nas decisões administrativas e legislativas que os afetam. Adota-se o método dedutivo e realiza-se pesquisa bibliográfica. Conclui-se que esse direito, reconhecido como direito humano no Brasil, tem aplicabilidade imediata, vinculando o poder público à sua implementação.
